End User Licence Agreement

This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a business entity) and Owtanet ("Licensor,") for the Flotilla software product ("Software"), which includes computer software and may include associated media and online or electronic documentation.

GRANT OF LICENSE

Subject to the terms and conditions of this Agreement, the Licensor grants you a non-exclusive, non-transferable license to install and use the Software on your own self-hosted servers or infrastructure.

RESTRICTIONS

You may not:
a) Reverse engineer, decompile, or disassemble the Software.
b) Modify, adapt, or create derivative works based upon the Software.
c) Rent, lease, lend, sell, redistribute, or sublicense the Software.
d) Remove, alter, or obscure any proprietary notices on the Software.

OWNERSHIP

The Software is licensed, not sold. The Licensor retains all rights, title, and interest in and to the Software, including all intellectual property rights.

SUPPORT AND UPDATES

The Licensor may provide you with support services related to the Software. Use of any such support services is governed by the Licensor's policies and programs described in user manuals or other materials provided by the Licensor.

TERMINATION

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term of this Agreement. Upon termination, you shall cease all use of the Software and destroy all copies of the Software in your possession.

DISCLAIMER OF WARRANTY

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE IS WITH YOU.

LIMITATION OF LIABILITY

IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with English Law, without giving effect to any principles of conflicts of law.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and the Licensor regarding the Software and supersedes all prior agreements, understandings, and communications, whether written or oral.

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.
